    SHADY REST CLOSES

    It appears this R/V and Mobile Home park, located in Sebastian, Florida, has finally closed. FOR SALE signs have been up for years and remain on the property. The closures across the entrances with signs saying Private Property are new. Manufactured/Mobile home communities are the last source of unsubsidized affordable housing for families and retirees in the state. They are either being sold for alternate land use or re-imagined into bargan land-lease resorts pricing out those who once found these parks affordable. It is a way of life disappearing across the entire state with nothing to replace it.

    House moving out of Park Place

    This home is located in Park Place - A SUN Signature Community in Sebastian, Florida. Half is gone and the other half is being readied for the move. Generally you are not able to move your carport or attached porches. It's unusual to see homes moved out of the resort communities. It is unclear why this home is being moved but lot rents here were under $400 not that long ago. Today they are about $800. Older homes in such communities can be difficult to sell if they are competing with much newer models. In some parks SUN Communities has instituted a Right of First refusal which could be used to prevent you from selling such a home to a broker. That could be what happened here. The latest trend seen in some parks is the takeover of such homes by the park owner who can subsequently rent them out. It's unclear if they even fall under 55+ rules as they are operated as rentals. In fact, rented in this manner, they may not fall under FS 723 or the rules of the park prospectus.

    Havenpark Capital Partners , on it's website, has this motto proudly displayed:"Creating stable, long-term income through a disciplined approach of acquiring and operating outstanding manufactured home communities" Thankfully they are not yet here in Florida. According to a recent article in the Des Moins Register they raised rents at  Waukee Mobile Home Park by 69% shortly after buying the property. To read the article click here.

    The largest increase following purchase we are aware of in Florida is 9%. Iowa has no statewide organization protecting the rights of mobile home owners in land-lease parks. Florida does - FMO. Next time a neighbor asks why you bother or why should they you can point out what's happening in other parts of the country as these corporate moguls devour parks soley  to produce passive income for their investors. Without FMO and the rights under FS 723 we work day and night to protect this could be in your future.

    Currently the Director of the Division of Condominiums, Timeshares, and Mobile Homes is Boyd McAdams.  He previously served as the Deputy Division Director.

    Amelia Shekitka remains the Bureau Chief of Standards. 

    Julie Scarbrough is now the Bureau Chief of Compliance.

    National Consumer Protection Week

     

    National Consumer Protection Week (NCPW), a nationwide consumer education campaign, is March 3-9, 2019. Commissioner Nikki Fried and the Florida Department of Agriculture and Consumer Services are encouraging consumers to take full advantage of their consumer rights, learn to spot fraud, and make better informed decisions.

    In recognition of NCPW, the Division of Consumer Services will host a free webinar on March 8, 2019, from 1:00 p.m. to 2:00 p.m. (EST), titled FDACS: Making a Difference for Florida's Consumers. The webinar will highlight the division's role in registering businesses and ensuring that they comply with their statutorily mandated requirements. It will also clarify the consumer complaints mediation and enforcement process, the fair rides inspection process, the division's role in tackling the use of credit card skimmers at gas station pumps and provide information on various other consumer protection topics. Consumers can register for the webinar by visiting www.FloridaConsumerHelp.com.

    The Division of Consumer Services is the state's clearinghouse for consumer complaints, information and protection. The division regulates various businesses, such as motor vehicle repair shops, charitable organizations, pawnbrokers, health studios, sellers of travel, intrastate movers, professional surveyors and mappers, sweepstakes/game promotions and telemarketers. In addition, the division protects consumers and businesses from unfair and unsafe business practices across a wide range of market sectors, including gasoline, brake fluid, antifreeze, liquefied petroleum gas, amusement rides, and weighing and measuring devices.

    Florida Public Service Commission (PSC) issues  NOTICE OF DEVELOPMENT OF RULEMAKING regarding rulemaking to adopt new Rule 25-30.0115, Florida Administrative Code, to define “landlord” and “tenant” as used in Section 367.022(5), Florida Statutes. This rule could bring park owned utilities under the jurisdiction of the PSC. A workshop is scheduled March 4th in Tallahassee. 

    HUD Advisory committee MHCC to meet April 30 - May 1 in Washington DC. FMO Board Member Russ Watson sits on this committee and expects to attend. Information on the meeting as well as where to direct public comment is found in the Federal Register.

    SUN Communities (SUI) annonced Q4 2018 Earnings. A complete report was given by CEO Gary Shiffman on the earnings call. Companies often disclose their outlook and future plans on these calls making them worth a look if you live in their communities.
